An illegal immigrant living in Ohio is scheduled for trial on charges of sexual assault against a minor. The defendant, Gerson Fuentes, is accused of committing rape on a nine-year-old girl, who subsequently had an abortion. His immigration status was identified by the Immigration and Customs Enforcement (ICE) agency.
Fuentes was indicted in July 2022 on two counts of felony rape, relating to alleged incidents that took place between January and May 2022. The case caught the attention of authorities following the minor’s abortion procedure in Indiana when she was ten years old, which subsequently led to Fuentes’ apprehension.
Prosecutors assigned to the case have argued that Fuentes is the father of the minor’s aborted fetus and have presented significant evidence to support these claims. Ohio law stipulates that if Fuentes is found guilty, he may face a life sentence without the possibility of parole. Nevertheless, the possibility of a plea agreement could potentially alter the course of charges and expedite sentencing.
Fuentes’ defense team has cast doubt on the DNA results and his alleged confession, citing Fuentes’ clean record. This case has triggered an investigation led by Indiana Attorney General Todd Rokita, and a lawsuit was filed by the medical professional who performed the abortion against Rokita. However, this lawsuit was later withdrawn after a judge ruled in favor of the investigation.
Further complexities arose when the Indiana Medical Licensing Board initiated an investigation into the medical professional’s conduct. The board concluded that she had breached her patient’s rights to privacy by discussing the case with the media and imposed a $3,000 fine. Currently, no public statement has been made by Fuentes’ legal representative regarding the ongoing proceedings.
