Financial Oversight and Management Board for Puerto Rico v. Centro de Periodismo Investigativo Inc.

Wednesday the justices will decide on whether a financial oversight board that Congress has established to manage Puerto Rico’s debt crisis has immunity from a public records lawsuit. States receive sovereign immunity in certain lawsuits, but Puerto Rico is a territory, leaving a grey area behind. The group however argues that the law establishing the board states – clearly – that the entity does not enjoy immunity in federal courts. While the board argues that the statute does not provide clear language revoking its sovereign immunity.
