New York Governor Expands Red Flag Laws

New York Governor Kathy Hochul has issued an executive order expanding the state’s Red Flag laws. Moving forward, New York’s Red Flag laws will be “shall issue”, meaning that the New York State police are going to all be trained on how to actually file Red Flag petitions and will be instructed to file them more frequently.

This new expansion of Red Flag laws came several days after the mass shooting in Buffalo, New York at a TOPs supermarket. The shooter is alleged to be a white supremacist inspired by the mass shooting in Christchurch, New Zealand and the Biden administration is has already announced that this is being considered an act of domestic terrorism.

This expansion of the current law is only going to change the way police do things, actual gun seizures are still going to be up to judges to decide. That being said, Governor Kathy Hochul might not be done yet.

Governor Hochul first said that there was going to be some major gun reform in the wake of the mass shooting in Buffalo during a press conference earlier this week. Hochul suggested heavily that bullets should be micro-stamped during that press conference.

In the near future, we may see legislation in New York that changes the way bullets are regulated. Legislators in New York have also pushed for the firearms industry to pay for the damages caused by the shooting.

I had a chance to speak with NYS Assembly Majority Leader Crystal Peoples-Stokes about the mass shooting that took place in Buffalo on Saturday, May 14, 2022. Payton Gendron of Conklin, New York, about 200 miles southeast of Buffalo, used what NPR says is a Bushmaster XM-15, an AR-15-style rifle to gun down 10 people and injured 3 others. Police also allegedly found a second rifle and a shotgun in his vehicle.

“Perhaps we’ll be able to turn the corner on this horrific situation that we live with in America – when people think that gun rights are more important than people.”
