White House Press Secretary Jen Psaki managed to explain away Joe Biden’s position on court packing in a recent White House Press Briefing.
On Friday Joe Biden signed an executive order to create a commission that would review the possible reforms to the Supreme Court, these reforms would include membership, size, and tenure.
In 1983 Joe Biden described the idea of packing the court as a “bonehead idea”, however Jen Psaki was able to wash away any criticism of his change on this position in a recent press briefing.

Biden signed an executive order on Friday to develop a commission to review possible reforms to the Supreme Court, including its “membership and size,” a White House press release said. The president’s move to establish the commission, which is charged with completing a report in 180 days, follows increasing pressure from activists to expand the court after three conservative justices were confirmed under the Trump administration, The New York Times reported.
“The makeup of this commission, which was vital for the president, is there are progressives on the Court, there are conservatives on the Court, people will present different opinions and different points of view and then they’ll have a report at the end of 180 days,” Psaki said.
Justice Stephen Breyer cautioned Tuesday that the public’s faith in the Supreme Court may decrease if the branch was enlarged since it would depict the institution as political, according to a Wednesday NYT report. The idea to pack the court was also rebuked by the Biden campaign in 2020, however now that the election is over the possibility that the Biden administration will pack the court is very real. Democrat activists recently tore into Justice Breyer over his position against court packing.
